Emily Johnson and her staff have been providing litigation support, divorce financial and tax analysis, and QDRO preparation throughout the Southeast since 2007. Our role as a member of the “divorce team” is ultimately two-fold: to assist the attorney by providing necessary analysis and synthesis of financial data needed to support the attorney’s case, and to help the client to develop a clear understanding of the marital financial estate and the impact of financial decisions made during settlement, mediation and the like.
Depending on the attorney’s preference, we can be retained directly by the attorney or by the client. We typically bill on an hourly basis for divorce financial analysis and expert work, but can also be retained on a flat fee basis for some limited tasks, such as QDRO preparation or pension valuation.
We also serve as the financial neutral in collaborative divorce cases, and in that role are retained by both spouses to provide services as a neutral financial expert. Our specific role or task in each case varied depending on the current status of the divorce, complexity of the financial assets involved, and financial experience of the divorcing parties. In some cases our role can be as limited as a simple pension valuation or preparation of the financial declaration/affidavit, yet in other cases we are retained not only to develop marital asset addendums, but to track cash flows, incorporate hard to value assets into financial settlements, and to assist in the structuring in creative financial solutions for parties with illiquid estates, pending bankruptcies, and complex assets such as restricted stock or other corporate benefits.
